Terms of Use
Hours of Work
Nu Studio operates from 9:00 AM to 5:00 PM, Monday to Friday, with availability outside these hours by prior arrangement. If the team is unavailable during business hours, we aim to respond to all communications within 24 hours. Please note, Nu Studio typically closes for 3–4 weeks over the summer, beginning the Friday before Christmas Day. Specific dates will be published on the website, communicated directly to clients, and shared via social media closer to the time.
Payment Terms
Additional consultations or design requests not outlined in the proposal will be charged at $150.00 per hour, plus GST. Full payment for the services described in this proposal is due upon completion, regardless of when the client chooses to complete the specified work. Invoices not paid by the due date will incur a 3% monthly interest charge on the total outstanding balance. If payment is overdue for 14 days or more, Nu Studio may issue a written notice requesting payment within 7 days. Failure to remedy the default within that period may result in the suspension or termination of services without further notice. Nu Studio is not liable for any damage or loss arising from such suspension or termination. The client will be responsible for any costs incurred by Nu Studio in recovering overdue payments, including legal fees and administrative costs.
Indemnity
Nu Studio takes care to recommend solutions that offer value, quality, and suitability, but cannot be held liable for defective materials or workmanship by contractors, workrooms, or manufacturers engaged by the client. Nu Studio holds comprehensive indemnity, public liability, and statutory liability insurance for the services provided. The client agrees to indemnify Nu Studio against any damage, loss, or expenses incurred due to a breach of this agreement by the client.
Client Responsibilities
The client agrees to provide all necessary information related to the project in a timely manner. Nu Studio cannot be held accountable for any recommendations or advice made based on insufficient or outdated information. Nu Studio will protect the client’s personal information and will not share it with third parties without explicit consent.
Client Decision-Making
While Nu Studio offers professional advice and expertise, the final decision regarding project specifications and recommendations rests with the client. If the client chooses to proceed with any of the Designer’s recommendations or works with another contractor or professional recommended by Nu Studio, the client assumes full responsibility for those decisions and their relationship with the third party.
Ownership of Work
All specifications, costings, designs, presentations, and schedules created by Nu Studio remain the property of the Designer. They may not be used for any purpose other than the project at hand. All products supplied to the client remain the property of Nu Studio until all invoices are paid in full.
Supply of Materials and Products
Nu Studio can source a wide range of products from both local and international suppliers. Due to established relationships with these suppliers, Nu Studio is often able to offer materials and products at discounted trade rates. Some of these discounts may be passed on to the client, allowing them to purchase at a price lower than retail. Additionally, Nu Studio may receive commission from suppliers on products specified and purchased directly by the client.
Dispute Resolution
Any disputes that cannot be resolved immediately will first be referred to mediation. This process does not apply to any claim for money owed by the client to Nu Studio.
Photography and Media
Nu Studio may photograph and publicise aspects of the project with the client’s prior agreement.
Termination of Agreement
Either party may terminate this agreement with 10 days’ written notice. Upon termination, the client is required to fully compensate Nu Studio for all completed services, products ordered on behalf of the client, and any contractual commitments made.
